Fairlane Golf, Inc. (“Fairlane”, “we”, “us”, or “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect personal information in connection with the Fairlane corporate website located at fairlanegolf.com and any related content, marketing materials, demonstrations, and informational resources made available by Fairlane (collectively, the “Site”).

Scope of This Privacy Policy. This Privacy Policy applies to information collected through the Site. It does not describe how Fairlane processes personal information on behalf of golf facilities that have subscribed to the Fairlane software platform (the “Platform”). When Fairlane processes personal information on behalf of a golf facility through the Platform, Fairlane acts as a processor or service provider on behalf of that facility, which is the controller or business with respect to such information. Each facility maintains its own privacy notice that describes its data practices, and you should consult that facility’s privacy notice for information about how your data is handled when you book a tee time, take a lesson, or otherwise interact with a facility through the Platform.

Read This Carefully. By accessing or using the Site, you acknowledge that you have read and understand this Privacy Policy. If you do not agree with our practices, please do not access or use the Site.

1. Information We Collect

We collect personal information that you provide directly to us, information we collect automatically when you use the Site, and information from third-party sources.

1.1 Information You Provide Directly

We collect personal information you provide when you interact with the Site, including:

  • Contact and Demographic Information. Your name, email address, mailing address, telephone number, job title, employer name, and similar information when you fill out a form, request a demo, contact sales, subscribe to a newsletter, register for a webinar or event, apply for a job, or otherwise communicate with us.
  • Account Credentials. If you create a Site Account, your username, password (in hashed form), and authentication factors.
  • Communications and Correspondence. The content of messages, emails, chat sessions, and other communications you send to us, including any attachments and information about your inquiry.
  • Job Application Information. If you apply for a job through the Site, your resume, cover letter, work history, education, references, salary expectations, work authorization status, and any other information you choose to provide as part of your application.
  • Marketing Preferences. Your preferences for receiving marketing communications, your opt-in or opt-out elections, and information about your interactions with our marketing communications.
  • Survey Responses and Feedback. Information you provide in response to surveys, polls, customer research, or feedback requests.

1.2 Information Collected Automatically

When you visit the Site, we and our service providers automatically collect certain information about your visit, including:

  • Device and Connection Information. Your IP address, device type, operating system, browser type and version, browser language settings, screen resolution, time zone, and similar technical information.
  • Usage Information. Information about how you interact with the Site, including the pages you view, the links you click, the content you engage with, the date and time of your visit, the referring URL, and the duration of your session.

  • Location Information. Approximate geographic location derived from your IP address (such as country, state, or city). We do not collect precise geolocation data through the Site.

1.3 Information from Third Parties

We may receive information about you from third parties, including marketing and analytics providers, business information providers, social media platforms (if you interact with us through them), referrals from existing contacts, and publicly available sources such as professional networking sites and business directories.

2. How We Use Information

We use the personal information we collect for the following purposes:

  • Providing and Operating the Site. To provide you with access to the Site, respond to your requests, and operate the Site.
  • Sales and Marketing. To respond to demo requests, contact you about our products and services, send marketing communications (subject to your preferences), measure and improve the effectiveness of our marketing, and personalize content based on your interests.
  • Customer Communications. To respond to your inquiries, provide customer support, send service-related notifications, and otherwise communicate with you regarding the Site.
  • Recruiting. To process and evaluate job applications, communicate with applicants, conduct interviews, and make hiring decisions.
  • Analytics and Improvement. To analyze how the Site is used, measure the effectiveness of features, and improve the Site, our marketing, and our products and services.
  • Personalization. To customize content, recommendations, and advertisements based on your interests and inferred preferences.
  • Security and Fraud Prevention. To detect, investigate, and prevent fraud, unauthorized access, security incidents, and other prohibited or unlawful activity, and to enforce our Terms of Service.
  • Legal Compliance. To comply with our legal obligations, respond to lawful requests from public authorities, establish or exercise legal rights, defend against legal claims, and otherwise comply with applicable laws and regulations.
  • Business Operations. For internal business operations such as accounting, auditing, planning, recordkeeping, and corporate transactions (including mergers, acquisitions, financings, and divestitures).
  • With Your Consent. For any other purpose with your consent or as otherwise permitted or required by applicable law.

Legal Bases for Processing (EEA, UK, and Similar Jurisdictions). Where applicable law requires a legal basis for processing personal information, we process personal information based on one or more of the following: your consent, where required; the necessity of processing for the performance of a contract or to take steps at your request prior to entering into a contract; our legitimate interests in operating, improving, and marketing the Site, provided such interests are not overridden by your interests, rights, or freedoms; or the necessity of processing to comply with a legal obligation.

3. Use of Artificial Intelligence and Automated Processing

We may use artificial intelligence (“AI”), machine learning, and automated tools to support our marketing, customer support, and analytics activities. We do not use solely automated processing of personal information collected through the Site to make decisions that produce legal effects concerning you or that similarly significantly affect you, except as may be permitted under applicable law and disclosed to you. We do not use the personal information of Site visitors to train third-party generative AI or large language models without explicit notice and any required consents.

4. How We Share Personal Information

We share personal information in the following circumstances:

  • Service Providers. We share personal information with third-party service providers that perform services on our behalf. These service providers are contractually obligated to use personal information only for the purposes for which it was disclosed and to maintain appropriate safeguards.
  • Marketing and Advertising Partners. We may share certain personal information with marketing and advertising partners to deliver relevant content and advertisements, measure marketing effectiveness, and analyze our marketing performance.
  • Affiliates. We may share personal information with our corporate affiliates, parents, and subsidiaries (as such may exist from time to time), for purposes consistent with this Privacy Policy.
  • Business Transfers. We may share personal information in connection with, or during negotiations of, any merger, acquisition, financing, reorganization, sale of company assets, bankruptcy, or other corporate transaction.
  • Legal Compliance and Protection. We may disclose personal information when we believe in good faith that disclosure is necessary to comply with applicable law, enforce our Terms of Service, prevent fraud or address security issues, protect the rights, property, or safety of Fairlane, our users, or others, or establish or defend legal claims.
  • With Your Consent. We may share personal information for any other purpose with your consent.

Sale of Personal Information; Cross-Context Behavioral Advertising. In the past twelve (12) months, Fairlane has not “sold” personal information for monetary consideration as that term is traditionally understood. However, the use of certain advertising and analytics cookies on the Site may constitute a “sale” or “sharing for cross-context behavioral advertising” under certain U.S. state privacy laws (including the California Consumer Privacy Act, as amended by the California Privacy Rights Act). You may opt out of these activities as described in Section 9 (Your Privacy Rights) and via the cookie preferences tool described in Section 8 (Cookies and Tracking Technologies).

5. International Data Transfers

Fairlane is based in the United States. The personal information we collect through the Site is processed and stored in the United States and may be transferred to, processed, and stored in other countries where our service providers operate. Some of these countries may have data protection laws that differ from the laws of your country and may not provide the same level of protection.

Where we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland to a country that has not been deemed adequate by the relevant supervisory authorities, we rely on appropriate safeguards to protect such transfers, which may include the European Commission’s Standard Contractual Clauses, the UK International Data Transfer Addendum, or other lawful transfer mechanisms.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by applicable law. The criteria we use to determine the appropriate retention period include the nature and sensitivity of the personal information, the purposes for which we process it, our ongoing relationship with you, our legal and contractual obligations, and applicable statutes of limitations.

When personal information is no longer needed, we will delete or anonymize it, except where retention is required for legal, audit, or other compelling business purposes.

7. Note Regarding Payment Information

Fairlane does not collect, store, or process raw payment card information through the Site. Where the Platform involves payment functionality, all payment processing is performed by Stripe, Inc. or its affiliates (“Stripe”), or by other independent third-party payment processors as identified in the applicable Platform agreement. Payment information you provide in connection with the Platform is governed by the privacy practices of the applicable payment processor and the applicable golf facility, not by this Privacy Policy.

8. Cookies and Tracking Technologies

The Site uses cookies and similar tracking technologies (such as web beacons, pixels, and local storage) to operate the Site, analyze usage, deliver advertising, and personalize your experience. The principal categories of cookies we use are:

  • Strictly Necessary Cookies. Required for the Site to function and cannot be disabled.
  • Performance and Analytics Cookies. Help us understand how visitors interact with the Site by collecting aggregated information.
  • Functional Cookies. Enable enhanced functionality and personalization.
  • Marketing and Advertising Cookies. Used to deliver relevant advertisements, measure advertising effectiveness, and limit how often you see an ad.

Cookie Preferences. You can manage your cookie preferences through the cookie preferences tool available on the Site or through your browser settings. Most browsers allow you to refuse cookies, delete existing cookies, or notify you when cookies are being sent. Please note that disabling certain cookies may affect the functionality of the Site.

Do Not Track. Some browsers transmit “Do Not Track” signals. The Site does not currently respond to such signals because no consensus interpretation of those signals has emerged. We honor opt-out preferences expressed through the cookie preferences tool and through the Global Privacy Control (“GPC”) browser signal where applicable law recognizes GPC as an opt-out mechanism.

9. Your Privacy Rights

Depending on where you live, you may have certain rights with respect to your personal information. These rights may include:

  • Right to Access. The right to request confirmation of whether we process your personal information and to obtain a copy of such information.
  • Right to Correction. The right to request correction of inaccurate or incomplete personal information.
  • Right to Deletion. The right to request deletion of your personal information, subject to certain exceptions.
  • Right to Portability. The right to receive a copy of your personal information in a structured, commonly used, and machine-readable format.
  • Right to Opt Out of Sale or Sharing. The right to opt out of the sale of your personal information or the sharing of your personal information for cross-context behavioral advertising, where applicable.
  • Right to Limit the Use of Sensitive Personal Information. The right to limit the use or disclosure of certain sensitive personal information, where applicable.
  • Right to Object. The right to object to certain processing activities, such as processing based on legitimate interests or processing for direct marketing purposes.
  • Right to Withdraw Consent. Where we rely on your consent as the legal basis for processing, the right to withdraw your consent at any time.
  • Right to Non-Discrimination. The right not to receive discriminatory treatment for exercising any of these rights.
  • Right to Lodge a Complaint. The right to lodge a complaint with a supervisory authority. Residents of the European Economic Area or the United Kingdom may contact their local data protection authority.

How to Exercise Your Rights. To exercise any of the rights described above, please contact us at hello@fairlanegolf.com. We will respond to your request within the timeframe required by applicable law. To protect your privacy and security, we will take reasonable steps to verify your identity before fulfilling your request.

Authorized Agents. You may use an authorized agent to submit a request on your behalf. We may require the authorized agent to provide proof of authorization and may require you to verify your own identity directly with us.

Appeals. If we deny your request, you may appeal our decision by contacting us at hello@fairlanegolf.com with the subject line “Privacy Rights Appeal.”

10. California-Specific Privacy Disclosures

This section provides additional information for California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”).

In the past twelve (12) months, we have collected the following categories of personal information from Site visitors, as defined by the CCPA: identifiers; commercial information; internet or other electronic network activity information; geolocation data (approximate, derived from IP address); professional or employment-related information (for job applicants); and inferences drawn from the foregoing. We have collected this information from the sources, used it for the purposes, and disclosed it to the categories of recipients described in Sections 1, 2, and 4 of this Privacy Policy.

We do not collect sensitive personal information through the Site for the purpose of inferring characteristics about you, except where you provide such information voluntarily as part of a job application.

As described in Section 4 of this Privacy Policy, the use of certain advertising and analytics cookies on the Site may constitute a “sale” or “sharing” of personal information under the CCPA. You may opt out of these activities through the cookie preferences tool on the Site or by contacting us at hello@fairlanegolf.com. We honor Global Privacy Control opt-out signals as a valid opt-out request under the CCPA.

California Civil Code Section 1798.83 permits California residents to request information about our disclosure of personal information to third parties for the third parties’ direct marketing purposes. To make such a request, please contact us at hello@fairlanegolf.com.

11. Children’s Privacy

The Site is not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under the age of thirteen (13) through the Site. If you are a parent or guardian and believe that your child has provided us with personal information through the Site, please contact us at hello@fairlanegolf.com and we will take appropriate steps to delete such information.

Note Regarding the Platform. Personal information about minors processed through the Platform on behalf of golf facilities is governed by the applicable facility’s privacy notice, not by this Privacy Policy.

12. Information Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. These safeguards include encryption of data in transit and at rest, access controls and authentication mechanisms, security monitoring, employee training, and vendor security reviews.

Despite our safeguards, no method of transmission over the internet or method of electronic storage is one hundred percent secure. We cannot guarantee absolute security. If you believe your interactions with us are no longer secure, please contact us immediately at [SECURITY EMAIL].

13. Third-Party Sites

The Site may contain links to third-party websites or services. This Privacy Policy does not apply to those third-party websites or services. We are not responsible for the privacy practices or content of any third-party websites or services. We encourage you to read the privacy policies of any third-party website or service you visit.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we update this Privacy Policy, we will revise the “Last Updated” date at the top of this Privacy Policy. If we make material changes, we will provide additional notice (such as by posting a prominent notice on the Site or by sending you an email if you have provided us with an email address) before the changes take effect.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. These Terms of Service (“Terms”) constitute a legal agreement between you (“you”) and Fairlane Golf, Inc., a Wyoming corporation (“Fairlane”, “we”, “us”, or “our”). These Terms govern your access to and use of the Fairlane corporate website located at fairlanegolf.com and any related content, marketing materials, demonstrations, and informational resources made available by Fairlane (collectively, the “Site”).

Separate Terms Govern the Fairlane Platform. If you are a golf facility, golf course, or related business that has subscribed or wishes to subscribe to the Fairlane software platform (the “Platform”), your use of the Platform is governed by a separate written agreement executed between you and Fairlane. These Terms govern only your use of the Site itself; in the event of any conflict between these Terms and your written Platform agreement with respect to the Platform, the written Platform agreement controls.

Arbitration and Class Action Waiver. These Terms include a binding arbitration agreement and a class action waiver in Section 16. By using the Site, you agree to resolve disputes with Fairlane through individual binding arbitration and waive your right to participate in class actions, as more fully described in Section 16.

1. Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to these Terms or to our Privacy Policy, you must not access or use the Site.

If you are accessing or using the Site on behalf of an entity, you represent and warrant that you have the legal authority to bind such entity to these Terms. In such case, the terms “you” and “your” refer to that entity.

You must be at least eighteen (18) years of age and have the legal capacity to enter into binding contracts in your jurisdiction in order to use the Site. The Site is not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under thirteen (13) through the Site.

2. Changes to These Terms or the Site

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Site or by other reasonable means. Your continued use of the Site after any such change constitutes your acceptance of the revised Terms.

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Site or any features, content, or services on the Site at any time, with or without notice.

3. Description of Services Available on the Site

The Site is a marketing and informational website operated by Fairlane. Through the Site, Fairlane provides information about the Platform and its features, marketing materials and educational content related to golf facility operations, tools to request a demonstration or contact us, job postings and recruiting tools, and other informational and marketing functionality as Fairlane may make available from time to time.

The Site Is Not the Platform. The Site is informational and marketing in nature. The Site does not, by itself, provide reservation booking, payment processing, or any of the operational capabilities of the Platform. Access to the Platform requires execution of a separate written agreement and authentication through the Platform's dedicated operator surface.

4. User Accounts on the Site

Most areas of the Site are accessible without creating an account. Certain features may require you to provide information about yourself or to register for an account on the Site (a “Site Account”).

If you create a Site Account, you agree to provide accurate information, maintain the security of your password and credentials, accept responsibility for all activities that occur under your Site Account, and notify Fairlane promptly of any unauthorized use. Fairlane reserves the right to suspend or terminate your Site Account at any time, with or without notice, in its sole discretion.

5. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree that you will not, and will not attempt to, do any of the following:

  • Use the Site in any manner that violates any applicable law or regulation;
  • Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site;
  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express prior written consent, except for legitimate search engine indexing in accordance with our robots.txt file;
  • Bypass, attempt to bypass, or circumvent any technical, administrative, or security measures we have implemented;
  • Introduce any viruses, malware, or other harmful or malicious software or code to the Site;
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, ideas, algorithms, or trade secrets of the Site or the Platform;
  • Use the Site or any data obtained from the Site to develop or improve any competing product or service;
  • Use the Site or any data obtained from the Site to train any artificial intelligence, machine learning, or large language model without Fairlane's express prior written consent; or
  • Encourage or assist any third party in any of the foregoing.

6. Intellectual Property

6.1 Fairlane Content

All content available on the Site, including text, graphics, logos, icons, images, software, and the compilation thereof (collectively, “Fairlane Content”), is the property of Fairlane or its licensors and is protected by United States and international intellectual property laws.

6.2 Limited License

Subject to your compliance with these Terms, Fairlane grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site solely for your personal or internal business purposes related to evaluating or learning about the Platform. This license does not include any right to reproduce, modify, sell, sublicense, or commercially exploit the Site or any Fairlane Content.

6.3 Trademarks

“Fairlane,” “Fairlane Golf,” the Fairlane logo, and other Fairlane marks are trademarks or registered trademarks of Fairlane. You may not use any Fairlane trademark without our express prior written consent.

6.4 Feedback

If you provide Fairlane with any suggestions, comments, ideas, or other feedback regarding the Site or the Platform (“Feedback”), you grant Fairlane a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use such Feedback for any purpose, without any obligation or compensation to you.

7. Important Disclaimer Regarding Payment Processing

Fairlane Is a Software Platform, Not a Payment Processor or Money Transmitter. Fairlane provides software services that integrate with third-party payment processors. Fairlane is not a bank, payment processor, money transmitter, money services business, or financial institution, and Fairlane does not receive, hold, or transmit funds on behalf of users.

Where the Platform involves payment functionality, all payment processing is performed by Stripe, Inc. or its affiliates (“Stripe”), or by other independent third-party payment processors as identified in the applicable Platform agreement. Each golf facility using the Platform is established as the merchant of record for payments processed through the Platform and is solely responsible for the processing relationship with its payment processor. Use of Stripe's payment processing services is subject to Stripe's terms, which form a separate, direct contractual relationship between each facility and Stripe. Fairlane is not a party to those terms.

Fairlane does not store, transmit, or process raw payment card data on the Site.

8. Third-Party Services and Links

The Site may contain links to third-party websites, services, products, or resources that are not owned or controlled by Fairlane. Fairlane has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Our collection and use of personal information in connection with the Site is described in our Privacy Policy, available at www.fairlanegolf.com/legal and incorporated herein by reference.

10. Disclaimers

THE SITE AND ALL FAIRLANE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FAIRLANE EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

FAIRLANE MAKES NO WARRANTY THAT THE SITE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SITE IS ACCESSED AT YOUR OWN DISCRETION AND RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAIRLANE, ITS AFFILIATES, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF FAIRLANE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR THESE TERMS, EXCEED ONE HUNDRED U.S. DOLLARS (US$100). THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above exclusions or limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Fairlane, its affiliates, and its and their respective officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of, or inability to use, the Site; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any applicable law or regulation.

13. Termination

Fairlane may terminate or suspend your access to the Site at any time, with or without cause, with or without notice. Upon termination, your right to use the Site will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive termination, including without limitation provisions regarding intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

14. Governing Law

These Terms and any action related thereto shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of laws principles.

15. Informal Dispute Resolution

Before initiating any formal proceeding (including arbitration as set forth in Section 16), you agree to first attempt to resolve any dispute informally by sending a written notice describing the dispute to hello@fairlanegolf.com (the “Notice”). The Notice must identify you, describe the nature of the dispute, and set forth the specific relief sought. The parties shall use good faith efforts to resolve the dispute within sixty (60) days after delivery of the Notice. If the dispute is not resolved within such period, either party may initiate arbitration in accordance with Section 16.

16. Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. THIS SECTION REQUIRES YOU TO ARBITRATE DISPUTES WITH FAIRLANE AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM US.

16.1 Agreement to Arbitrate

Except for disputes that qualify for small claims court and disputes seeking injunctive or other equitable relief in connection with intellectual property rights, all disputes between you and Fairlane shall be resolved exclusively through final and binding arbitration. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. The arbitration shall be conducted in the English language by a single arbitrator. The seat and venue of the arbitration shall be Cheyenne, Wyoming, unless you and Fairlane agree otherwise in writing.

16.2 Class Action Waiver

YOU AND FAIRLANE AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator shall not consolidate more than one party’s claims and shall not preside over any form of representative or class proceeding.

16.3 Federal Arbitration Act

This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq.

16.4 Right to Opt Out of Arbitration

You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to hello@fairlanegolf.com within thirty (30) days after first becoming subject to these Terms. Such notice must include your name, address, and a clear statement that you wish to opt out of arbitration. If you do not opt out within such thirty (30) day period, you agree to be bound by this arbitration agreement.

17. Notices

All notices to Fairlane under these Terms shall be in writing and shall be sent by email to hello@fairlanegolf.com or by certified or registered mail (return receipt requested) to: Fairlane Golf, Inc., 927 Main Street, STE 700, Evanston, Wyoming 82930, United States. Fairlane may provide notice to you by email, through the Site, or by any other reasonable means.

18. Miscellaneous

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fairlane regarding the Site and supersede all prior agreements with respect to the Site.

Severability. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect.

Waiver. No waiver by Fairlane of any term shall be deemed a further or continuing waiver, and any failure of Fairlane to assert a right shall not constitute a waiver of such right.

Assignment. You may not assign these Terms without Fairlane’s prior written consent. Fairlane may freely assign these Terms.

Force Majeure. Fairlane shall not be liable for any failure or delay in performance due to any cause beyond its reasonable control.
